TERMS OF SERVICE

1. Overview

These Terms of Service (“Terms”) govern your access to and use of the website and advisory services provided by Tour Performance Advisory (“TPA,” “we,” “us,” or “our”).

TPA provides private, subscription-based performance advisory services. By accessing this website, applying for services, or enrolling in a subscription, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use our services.

2. Nature of Services

Tour Performance Advisory provides strategic performance advisory services delivered on a private, subscription basis.

All services are advisory in nature. We do not guarantee specific results, rankings, competitive outcomes, financial outcomes, or performance improvements.

Implementation of advisory guidance remains the sole responsibility of the client.

3. Eligibility

By enrolling in our services, you represent that:

  • You are at least 18 years of age and have the legal authority to enter into binding agreements; or
  • If the participant is under 18 years of age, you are the participant’s parent or legal guardian and you are enrolling on their behalf with full authority to enter into this agreement.
  • All information provided during enrollment and checkout is accurate and complete.

4. Enrollment and Acceptance

Enrollment in advisory services is subject to acceptance at our sole discretion.

We reserve the right to decline or discontinue service to any individual at our discretion.

A subscription is not considered active until payment has been successfully processed.

5. Subscription Terms and Billing

Advisory services are offered on a recurring subscription basis.

Each subscription requires a three (3) month minimum commitment unless otherwise specified in writing.

After the initial commitment period, subscriptions renew automatically on a monthly basis unless canceled prior to the next billing cycle.

By enrolling, you authorize recurring billing to your designated payment method.

You are responsible for maintaining accurate and current payment information.

Failure to maintain valid payment information may result in suspension or termination of services.

6. Refund Policy

All payments are subject to our Refund Policy, which is incorporated into these Terms by reference.

Because advisory services allocate time, access, and strategic capacity in advance, payments are non-refundable once a billing period begins.

7. Cancellations

Cancellation requests must be submitted prior to the next billing date.

Cancellations become effective at the end of the current billing period.

Early termination during the initial minimum commitment period does not relieve the obligation to complete remaining payments.

8. Chargebacks and Payment Disputes

You agree to contact Tour Performance Advisory directly to resolve any billing concerns prior to initiating a chargeback or dispute with a financial institution.

Initiating a fraudulent chargeback may result in immediate termination of services and legal recovery efforts where applicable.

9. Intellectual Property

All materials, content, frameworks, documents, systems, and advisory materials provided by TPA remain the intellectual property of Tour Performance Advisory.

No content may be reproduced, distributed, shared, or commercialized without prior written consent.

Advisory access does not grant ownership of intellectual property.

10. Limitation of Liability

To the fullest extent permitted by law, Tour Performance Advisory shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from participation in advisory services.

Our total liability for any claim shall not exceed the amount paid by you for the most recent billing period.

11. Indemnification

You agree to indemnify and hold harmless Tour Performance Advisory, its officers, contractors, affiliates, and service providers from any claims, damages, or liabilities arising from:

  • Your misuse of advisory services
  • Your breach of these Terms
  • Your violation of applicable laws

12. Relationship with Shopify

Tour Performance Advisory is powered by Shopify, which enables payment processing and website functionality.

All purchases and subscription agreements are made directly with Tour Performance Advisory.

Shopify is not responsible for any aspect of advisory services provided by TPA.

13. Privacy

All personal information collected through this website is governed by our Privacy Policy.

By using our services, you consent to the collection and processing of information in accordance with that policy.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles.

Any disputes shall be resolved in the state or federal courts located in Florida.

15. Modifications

We reserve the right to update or modify these Terms at any time. Continued use of the services following any changes constitutes acceptance of those changes.
